Welcome to KartingData. Please read these Terms of Service ("Terms") carefully before using the KartingData mobile application (the "App") operated by us.
By creating an account or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.
You acknowledge that karting and motorsport activities are inherently dangerous and carry significant risks of physical injury, death, and property damage. You use this App entirely at your own risk.
You agree to follow all rules, regulations, and instructions provided by the karting track or venue where you are using the App.
The App provides real-time visual and audio data. You agree not to interact with the App (e.g., touching the screen) while driving. You must maintain full attention on the track and your surroundings at all times.
The App uses a token system to access certain features. Tokens are virtual goods licensed to you, have no monetary value, and cannot be redeemed for cash or transferred to other accounts.
We may offer subscription plans (e.g., "Unlimited Access"). These are billed in advance on a recurring basis.
All financial transactions (purchasing tokens or subscriptions) are handled entirely by the third-party platform you use (Apple App Store or Google Play Store).
No Direct Refunds:KartingData does not process payments or refunds. Any refund requests must be submitted directly to Apple or Google in accordance with their respective refund policies.
The App and its original content (excluding User Data), features, and functionality are and will remain the exclusive property of KartingData.
To provide features like "Kart Parity Scores," "Leaderboards," and "Kart Debriefs," we need the right to use the data generated during your sessions. By using the App, you grant KartingData a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any data, text (such as kart notes), telemetry, and session information generated or uploaded by you.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may simply discontinue using the App.
To the maximum extent permitted by applicable law, in no event shall KartingData be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
We assume no responsibility for the safety of your device or your person while participating in motorsport events. You understand that you are using this App in a high-risk environment and accept all associated risks.
For users in the United Kingdom: Notwithstanding the above, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, and for fraud or fraudulent misrepresentation.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the data provided (e.g., lap times, gaps) will be perfectly accurate or synchronized with the official track timing system. You should not rely on the App as a substitute for official race control instructions or flags.
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
